W. Dudley McCarter Of Counsel

Profile

For over 50 years, Dudley has represented contractors, subcontractors, owners, design professionals and public entities in a variety of business and construction disputes. He has handled hundreds of disputed matters that were litigated in jury trials, bench trials and arbitrations. He successfully argued the landmark case of Byrne & Jones v. Monroe City School District before the Supreme Court of Missouri.  In that case, the Missouri Supreme Court held for the first time that an unsuccessful bidder on a public project was entitled to challenge the bid award on the grounds that it was denied a fair and equal opportunity to compete for the bid even though it was not a taxpayer of the public entity. This case overruled cases going back 75 years.

Dudley has been selected for inclusion in Best Lawyers in America for over 30 consecutive years in the areas of business and construction litigation and was named Construction Lawyer of the Year in Missouri by Best Lawyers. He is a certified mediator for the U. S. District Court.
